Our colleagues have published an article entitled “The exclusion from public procurement procedures for breaches of competition law: the Spanish Competition Authority’s decision in Eólica del Alfoz” in Comunicaciones en Propiedad Industrial y Derecho de la Competencia, nº 106.
This decision marks the first occasion on which the CNMC has imposed an exclusion from public procurement procedures pursuant to Notice 1/2023, determining both its scope and duration. The authors assess how the Authority has taken into account all the criteria set out in Notice 1/2023 when determining the scope and duration of the exclusion.
