Las sentencias del Tribunal General y del Tribunal de Justicia en el caso Altice: consecuencias para las futuras decisiones de la Comisión Europea en materia de «gun jumping»- Rafael Allendesalazar
Nuestro socio Rafael Allendesalazar ha publicado un capítulo en el reciente Anuario de Derecho de la Competencia 2024, coordinado por Miguel Ángel Recuerda Girela, sobre las Sentencias del Tribunal General y del Tribunal de Justicia en los recursos contra la Decisión de la Comisión que impuso dos multas idénticas a Altice por gun juming. Ambas sentencias siguen la línea formalista marcada por la Sentencia Marine Harvest, y consideran que existe una obligación de notificar la concentración distinta de la de no ejecutarla, pese a reconocer que es imposible infringir la primera sin infringir la segunda.
Pero tanto el Tribunal General como el de Justicia reducen, por primera vez en un asunto de gun jumping, la multa por la infracción de la “obligación” de notificar. La Comisión Europea ya no podrá, como hasta ahora, seguir imponiendo dos multas idénticas sin ninguna justificación. Lo previsible es que, en los próximos casos de gun jumping ante la Comisión, las sanciones por no notificar sean sensiblemente inferiores a las impuestas por ejecutar la operación antes de ser autorizada.
Our partner Rafael Allendesalazar has published a chapter in the recent Anuario de Derecho de la Competencia 2024, coordinated by Miguel Ángel Recuerda Girela, on the rulings of the General Court and the Court of Justice in the appeals against the Commission’s decision imposing two identical fines on Altice for gun jumping. Both rulings follow the formalistic line set by the Marine Harvest ruling and consider that there is an obligation to notify the concentration different from the obligation not to implement it, despite admitting that it is impossible to infringe the former without infringing the latter.
But both the General Court and the Court of Justice reduced, for the first time in a gun jumping case, the fine for the infringement of the «obligation» to notify. The European Commission will no longer be able, as it has done until now, to continue imposing two identical fines without justification. It is foreseeable that, in future gun jumping cases before the Commission, the fines for not notifying will be significantly lower than those imposed for implementing prior to approval.
